At Archer, your privacy is a top priority. It is at the core of the way we design and build the services and products you know and love, so that you can fully trust them and focus on building meaningful connections.

As part of our commitment to transparency in the way we process your information, we explain here what profiling is, why it is at the very heart of our service (in fact, it’s probably the reason you love using our products!) and how you benefit from it. 

What is profiling?

Various privacy laws in the US and around the world address profiling and automated decision-making. For example, Europe’s data protection framework, the General Data Protection Regulation (“GDPR”), provides the following definitions:

• Automated individual decision-making: making a decision about an individual solely by automated means (i.e., using computers and algorithms only, without any human involvement in the decision-making process);
• Profiling: evaluating certain things about an individual, including interests, preferences or behavior, through an automated processing of personal data (e.g., using computers and algorithms to determine someone’s interests based on his or her online behavior).

Does Archer rely on profiling or automated decision-making?

Automated decision-making and profiling are invisible features at the core of the services you know and love, upon which we constantly improve and without which we would be unable to help you build meaningful connections. We use profiling for the following reasons:

To help connect you with other users.

We use the information you and other members of the Archer community provide us directly or through your use of the service (including, for example, age, gender, location, interests, and who you like, skip, or match with) to power our proprietary matching algorithm and recommend compatible people to you. We use the same process to recommend you to other users.

To show you ads and offers that may be of interest to you.

We use information about you to show you useful and relevant ads on and off our service and measure the effectiveness of these ads. We also use information about you to deliver offers and discounts tailored to your profile.

To promote safety and security. 

We use automated decision-making and profiling as part of our moderation efforts (for example, removing bots), as well as to promote the safety and security of our users by making it easier to prevent illegal and unauthorized actions from happening and to swiftly and efficiently detect and fight those actions when they happen. 

This processing may lead to suspension or account closure for users who are reported or found to engage in illegal or unauthorized activities, both on and off our services, without prejudice to other legal actions we could take.

Official Rules

THESE OFFICIAL RULES ARE A CONTRACT — READ THEM CAREFULLY BEFORE ENTERING. WITHOUT LIMITATION, THIS CONTRACT INCLUDES A RELEASE AND LICENSE FROM YOU, AND A LIMITATION OF CERTAIN OF YOUR RIGHTS AND REMEDIES.

NO PURCHASE NECESSARY. PURCHASES DO NOT INCREASE ODDS OF WINNING. ODDS OF WINNING DEPEND ON NUMBER OF ELIGIBLE ENTRIES RECEIVED. VOID WHERE PROHIBITED.

1. Promotion and Sponsor. Participation in the Archer App Survey promotion (the "Promotion") constitutes Entrant's (as defined below) full and unconditional agreement to these Official Rules. Entrant is free to disclaim any prize and status as Entrant, and as a result will not be eligible to receive any prize. The Promotion is sponsored and administered by GDA, LLC, 809 Washington Street, New York, NY 10014, ("Sponsor"). All decisions related to, as well as all interpretation of, these Official Rules by Sponsor are final and binding. While this Promotion may be promoted via social media websites, such websites are not affiliated with Sponsor or this Promotion. This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, Twitter, Instagram, Snapchat or any other third-party website or application that might host content where information about this Promotion is published (collectively "Content Hosts"). Entrant is providing information only to Sponsor and not to Content Hosts.

2. Promotion Period. The Promotion begins at 1:00 PM EST on April 4, 2024, and ends at 11:59 PM EST on April 21, 2024 (the "Promotion Period"). Only entries submitted and received during the Promotion Period will be accepted. Sponsor is the official timekeeper of this promotion.

3. Eligibility. The Promotion is open only to legal residents of the Continental United States, age 18 or older, who at the time of entry have a valid and active account on the Archer App.  Employees or agents of Sponsor or its parent or affiliate companies, vendors, suppliers, consultants, sub-contractors, distributors, legal counsel, or advertising, marketing, public relations, or promotional/fulfillment agencies, as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee or agent, are not eligible.  Legal entities are not eligible to enter.  Eligibility is contingent upon agreement to, compliance with, and fulfillment of all requirements of these Official Rules.  Participation in the Promotion in any way, including submission of any entry or the partial completion of any act of entry or any other step taken to participate in the Promotion in any manner, constitutes full and unconditional agreement with all provisions of these Official Rules. 

4. How to Enter.  NO PURCHASE NECESSARY. PURCHASES DO NOT INCREASE ODDS OF WINNING. There is one method of entry. By participating in the Promotion in any way you will become an "Entrant." Each Entrant who enters using the below method of entry will receive one entry in the Promotion. Limit one eligible entry per person and per Archer account.

Archer Entry During the Promotion Period, you will automatically become an Entrant and receive one entry in the Promotion by clicking on the prompt presented to you by Archer via in-app modal, email, or push notification, and completing and submitting the resulting survey.

5. Conditions of Entry. By entering or participating in this Promotion, Entrant agrees to be bound by these Official Rules and the decisions of Sponsor and its authorized representatives, which are final and binding in all matters concerning this Promotion. Entries not legitimately submitted in accordance with these Official Rules are void. Only qualified entries received by Sponsor during the Promotion Period are eligible for participation.
Entrants may be required to provide the following information to be eligible for a Promotion prize: first, middle and last name, month, day and year of birth, email address, complete mailing address, and phone number (collectively or individually, "Personal Information"). All requested Personal Information must be provided to participate in the Promotion and to be eligible to win a prize. Personal Information may be collected through phone, email, the Promotion survey, social media message, the Archer mobile application, or text message, and will be used by Sponsor solely for Promotion administration. Entries with incomplete, invalid, incorrect, or noncurrent information and entries that are counterfeit, damaged, or tampered with in any way will be disqualified. Entries that are late, lost, damaged, misdirected, stolen or not delivered are not the responsibility of Sponsor and will be disqualified. Sponsor is not responsible if a potential winner does not receive a prize because erroneous, expired, canceled, fraudulent, or fake information was provided during the Promotion. Proof of sent entry and/or entry receipt (such as a copy of a "thank you" message) does not constitute proof of actual receipt of entry by Sponsor for purposes of this Promotion.
Participation must be by Entrant. Participation by any other individual or entity, or originating at any other website, email address, or phone number, including, but not limited to, commercial promotion, subscription notification, and promotion entering service sites, is invalid and will be disqualified from this Promotion. Any attempt by any Entrant to obtain more than the stated number of entries by using multiple email addresses, phone numbers, identities, registrations, or logins; entries through a sweepstakes club or similar entity; or any other unauthorized method of entry will void all of Entrant's entries and Entrant will be disqualified from the entire Promotion. Submitting mass entries or entries generated by an automated program, script, or macro, or the use of any other similar device, program, or method to enter this Promotion is prohibited and will result in disqualification.
In the event of a dispute as to the identity of Entrant, the authorized account holder of the email address associated with the Archer account used to enter will be deemed to be Entrant. A potential winner may be required to show proof of being the authorized account holder. The "authorized account holder" of an email address is the natural person assigned to that email address by any organization (business, educational institution, etc.) responsible for assigning accounts to that email address. If the identity of the individual who actually participated in the Promotion cannot be resolved to Sponsor's satisfaction, the affected individual's entry will be deemed ineligible.
Sponsor may, in its sole discretion, disqualify any individual it finds to be in violation of these Official Rules, tampering with the entry process or the operation of the Promotion (including, but not limited to, tampering with websites, email addresses, or phone numbers), or acting in a non-sportsmanlike or disruptive manner. Any attempt to undermine the operation of the Promotion may be a violation of criminal or civil law, and Sponsor may seek damages to the fullest extent permitted by law from any person it finds to have made such an attempt.

6. Prize. There are 4 prizes available to be won. Each prize consists solely of a USD $50 gift card. Approximate Retail Value ("ARV") of all prizes (inclusive of all components) is USD $200.
All additional costs, including without limitation, taxes, and other personal charges not specifically described as part of the prize above are not included in the prize. No compensation or substitution will be provided for any difference in prize value. Sponsor is in no way responsible for any cancellations, delays, postponements, diversions, substitutions, changes in service or accommodations, or any other act, omission, or result thereof, caused by any third party. All prizes must be accepted as awarded without substitution and are not, in whole or in part, assignable, transferable, or available for resale. Prizes have no cash surrender value, except where required by law. Sponsor has made no warranty, representation, or guarantee, express or implied, in fact or in law, with respect to any prize. This includes, without limitation, any warranty, representation, or guarantee related to any prize's quality or fitness for a particular purpose. Prizes are subject to availability and Sponsor may substitute a prize (or a component thereof) with another prize of equal or greater value if the prize is not available for any reason, as determined in Sponsor's sole discretion. Other prize substitution options are available where required by law. Federal, state, and local taxes and all other costs and expenses associated with acceptance and use of any prize not specified herein as being awarded are each winner's sole responsibility. Prize specific terms and conditions apply. If any winner elects not to partake in any portion of the prize, any remainder of the prize that is unused will be forfeited and will not be subject to further or additional compensation.
Any prize details not specified above will be determined by Sponsor in its sole discretion.
Only the number of prizes set forth in these Official Rules will be awarded. In the event that any error, mistake, failure or discrepancy causes more than the stated number of prizes as set forth in these Official Rules to be promoted, noticed or claimed, Sponsor may award only the stated number of prizes by conducting a random drawing from among all legitimate, unawarded, eligible prize claims.

7. Winner Determination and Verification. The process leading to the random selection of the potential prize winners is within the sole discretion of Sponsor. Within a reasonable time after the end of the Promotion Period, the potential winners will be randomly drawn from the pool of all eligible entries received during the Promotion Period. Each potential winner is subject to eligibility verification, on an ongoing basis, by Sponsor, whose decisions are final and binding. An Entrant is not a winner of any prize, even if notified of being a winner and/or issued any item of value, unless and until Entrant's eligibility has been, and continues to be verified to the satisfaction of Sponsor.

To be verified as eligible to receive a prize, each potential winner must fulfill all requirements and continue to comply with all terms and conditions of these Official Rules, and not be disqualified for any reason. Each potential winner will be notified by phone, email, the Promotion entry form, social media message, the Archer mobile application, or text message (subject to Sponsor's discretion). If a potential winner of any prize cannot be contacted using the information provided, or fails to respond to Sponsor's attempt to notify them of selection within two business days; if any prize or notification is returned as undeliverable or yields an error or undeliverable type "bounce back" email (regardless if the message is ultimately delivered to the recipient); if a potential winner fails to sign and return the Release or any other required documentation or fails to comply with these Official Rules; if a potential winner is unable or unwilling to accept the prize (or any portion) as stated; or if a potential winner cannot be verified as eligible for any reason at any time before, during, or after the Promotion Period, the potential winner is disqualified and forfeits the prize (or relevant portion, subject to Sponsor's discretion), and an alternate potential winner will be randomly selected from among the remaining eligible entries.
In the event that an Entrant or a potential winner is disqualified or fails to claim a prize for any reason, the foregoing process will be repeated until all prizes are awarded, or until three attempts have been made to award each prize and each attempt has failed. IF THE PRIZE REMAINS UNAWARDED FOR ANY REASON AFTER THREE ATTEMPTS, THE PRIZE WILL NOT BE AWARDED IN THIS PROMOTION. A winners list may be obtained by printing the requestor's name, address, city, state or province/territory and zip or postal code on a 3x5" postcard and mailing it to GDA, LLC, Attn: Archer App Survey Sweepstakes Winners List, 809 Washington Street, New York, NY 10011 . Limit one request per person, per household.

8. Limitations of Liability. By entering or participating in this Promotion or any prize in any way, each Entrant agrees to indemnify, defend (regardless of ultimate liability), and hold harmless, and thereby does release and discharge Sponsor and the Content Hosts, and each of their respective parent and affiliate companies, vendors, suppliers, consultants, sub-contractors, distributors, legal counsel, and advertising, marketing, public relations, and promotional/fulfillment agencies, and each of their respective parent companies and each such company's officers, directors, employees and agents, as well as the immediate family (spouse, parents, siblings and children) and household members of each such individual (collectively, the "Released Parties") from and against any loss, damage, injury, claim, or cause of action related in any way whatsoever to this Promotion, these Official Rules, or the rights, consents and licenses granted to Sponsor under these Official Rules, including, but not limited to, infringement of any right of publicity or intellectual property; threatened or actual injury, loss or damage to any person, including death and disability; defamation or portrayal in a false light (intentional and unintentional); invasion of privacy; and damage to or loss of property, arising out of such Entrant's participation in the Promotion or receipt or use, non-use or misuse of any prize. To the maximum extent allowed by law, in no event will Released Parties be responsible or liable for any damages or losses of any kind, including indirect, incidental, consequential or punitive damages arising out of this Promotion. (Some jurisdictions may not allow the limitations or exclusion of liability for incidental or consequential damages or exclusion of implied warranties. Check local laws for restrictions regarding these limitations or exclusions.)Entrants waive any right to claim ambiguity in these Official Rules. The Released Parties are not responsible for: (1) technical failures of any kind; (2) incorrect or inaccurate information, whether caused by Entrants, any internet or email service provider, any promotional or advertising agency, printing or computing errors, or by any of the equipment or programming associated with or utilized in the Promotion; (3) unauthorized human intervention in any part of the entry process or the Promotion; (4) technical or human error that may occur in the administration of the Promotion, the processing of entries or the announcement of the winners and prize; (5) any injury or damage to persons or property, including without limitation computers, phones, and tablets, that may be caused, directly or indirectly, in whole or in part, by Entrant's participation in the Promotion or access to the Promotion materials; (6) the receipt, use or misuse of any prize; or (7) any other errors in any materials, information or announcements associated with the Promotion. If for any reason an Entrant's entry is confirmed by Sponsor to have been erroneously deleted, lost, or otherwise destroyed or corrupted by Sponsor, Entrant's sole remedy is another entry in the Promotion, subject to availability and provided that the Promotion Period has not then expired.
EACH ENTRANT AND WINNER WAIVES CALIFORNIA CIVIL CODE § 1542 (AND ALL SIMILAR LAWS OF ANY STATE OR TERRITORY OF THE UNITED STATES), WHICH READS: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM MUST HAVE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.” EACH ENTRANT AND WINNER REPRESENTS AND WARRANTS FULL UNDERSTANDING OF, AND ACKNOWLEDGES THE SIGNIFICANCE AND CONSEQUENCE OF, WAIVER OF CALIFORNIA CIVIL CODE § 1542 (AND ALL SIMILAR LAWS OF ANY STATE OR TERRITORY OF THE UNITED STATES).

9. LICENSE FROM ENTRANT. To the extent allowed by law, participation in the Promotion in any way or acceptance of, or participation in, any prize constitutes each Entrant's consent for, and grant of a non-exclusive, sub-licensable and assignable license to Sponsor to use, publish, post, or display Entrant's name, social media handles, likeness, photograph, voice, opinions, statements, prize information, biographical information, and hometown and state, province, or territory, regardless of whether altered, distorted, or used alone or with other material, in Sponsor's sole discretion, for promotional, advertising, trade, and publicity purposes in any medium now known or later discovered, worldwide and in perpetuity, without review or approval, and without further notice, payment, or consideration of any kind.
All rights, consents and licenses granted to Sponsor under these Official Rules or the Release will survive the termination of this Promotion. Such consents and licenses may only be revoked in writing, and the mere ending of this Promotion or Promotion Period is not sufficient to revoke such consents or licenses.

10. Right to Modify or Cancel. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event any provision is found invalid or unenforceable, these Official Rules will otherwise remain in effect in accordance with their terms as if the invalid or unenforceable provision was never included. Sponsor's failure to enforce any provision of these Official Rules does not constitute a waiver of that provision.
Sponsor may cancel, suspend or modify the Promotion or any part of it, in any way, subject to Sponsor’s sole discretion, if Sponsor determines in its sole discretion that the Promotion is not capable of executing as Sponsor intended, or that any mistake, clerical or typographical error, omission, fraud, technical failure, tampering, computer virus, or other factor, technical or otherwise, beyond Sponsor's reasonable control, impairs or may impair Sponsor's ability to properly conduct the Promotion, subject to any applicable law or regulation. In such event, Sponsor may, but is not obligated to, award any applicable prize(s) by conducting a random drawing from among the eligible entries received up to the time of the cancellation, suspension, or modification of the Promotion. Inclusion in such random drawing is Entrant's exclusive remedy under such circumstances.
In the event of an inconsistency between these Official Rules and any disclosure or other statement contained in any Promotion-related materials, including, but not limited to, a Promotion entry form or any point-of-sale, radio, television, print, or online advertising, these Official Rules will prevail and govern.

11. Disputes. Except where prohibited by law, Entrant agrees that: (1) all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded will be resolved individually, without resort to any form of class action, and exclusively by the appropriate federal or state court located in Dallas County, Texas; and (2) all claims, judgments and awards will be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys' fees. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights or obligations of Entrant or Sponsor in connection with the Promotion, are governed by and construed in accordance with the laws of the State of Texas, without giving effect to any choice of law or conflict of law rules that would cause the application of the laws of any other jurisdiction.

12. Privacy. By entering this Promotion, Entrant agrees to Sponsor's manner of collection, use, retention, and disclosure of Entrant's Personal Information submitted in connection with the Promotion. Personal Information collected from Entrant is subject to Sponsor's privacy policy, which can be found at https://www.archerapp.com/privacypolicy.

To support daily business and technical operations

Operating Archer involves a lot of daily business and technical operations, including hosting data securely, providing you good customer care support, operating advertising and marketing campaigns, understanding what users like or dislike about our services so we can make them better, performing research and development, facilitating payments, managing revenue and accounting, fighting against spam, abuse, fraud and similar harmful behaviors, and others. We share information about you with affiliated companies so they can help us perform some of these daily operations as our service providers.

To help keep you and others safe

We share and receive information about you with/across Match Group companies to aid us in our efforts to keep you safe. This enables us to do things like:

• Investigate, identify and take action against (e.g., ban) fake accounts, spam, abuse, fraud and other wrongdoings across Match Group services.
• Verify legitimate accounts across Match Group services, for instance by giving your accounts a “verified” status on multiple services, rather than just the one you actively verified on.
• Identify and combat potential discrimination or bias, by improving our ability to check the design and usage of Match Group services against discriminatory or biased outcomes.
• Work with law enforcement when we suspect things such as fraud or harmful or illegal activity, or to help prevent death or imminent bodily harm.

To provide features across Match Group

Depending on the service you use and the country you’re in, we might offer some features involving other Match Group Brands. For instance, in order to improve your chances at building significant connections with others, we may show your profile on other Match Group services or allow you to benefit from other cross-platform functionalities.  We will of course comply with applicable law and, where relevant, notify you of any such opportunity and allow you to agree or to refuse.

To personalize your experience on Match Group services (only applies to users of Archer, OkCupid, Plenty of Fish, Match, Stir, BLK, Upward and Chispa, located in the USA, excluding Utah, California, Colorado, Connecticut and Virginia)

If you’re using more than one Match Group service, sharing your information with other Match Group companies allows us to personalize your experience across these services. This personalization includes:

• How your profile is shown to other users and how others’ profiles are shown to you. For instance, this enables us to tailor the profile recommendations you’re getting on Archer based on your preferences and matching behavior on another service.
• The prices and discounts you’ll experience on the Match Group services you use. For instance, the prices and discounts you may see for our service may vary, based on the fact that you also use another Match Group service or used a paid feature on that other service.
• What ads you’ll see while using Match Group services. For instance, you might see ads on another Match Group service targeted based on interests you listed on your account with us.

To help promote Match Group’s services (only applies to users of Archer, Okcupid, Plenty of Fish, Match, Stir, BLK, Upward, Chispa and The League, located in the USA, excluding Utah, California, Colorado, Connecticut and Virginia)

Like other online providers, Match Group companies run ads promoting their services on third party platforms like Facebook, Instagram, Snapchat, TikTok and others. To power this marketing effort and target it at the right audience, companies typically share identifiers of existing members with the third party platforms on which they run ads, to either exclude these members from their marketing campaigns, or to target their ads at them or at an audience that is similar to them in terms of background, interests or app usage. Your identifiers can be used and shared as laid out above to promote Archer and other Match Group services. As an example, another Match Group company whose service is highly engaged with by the single parent, the Black or the LGBTQ+ communities may run ads on Facebook to an audience that was created using identifiers of our single parents, Black or LGBTQ+ members.

To understand how people use Match Group services (only applies to users located in the USA)

 Sharing information helps us understand how people use Match Group services, for instance by more accurately counting the number of unique registered, active or paid users across Match Group services, how many Match Group services they use on average, how people go from one to the other, and how usage patterns might differ.

This Privacy Policy applies to websites, apps, events and other services we operate under the brand Archer.  For simplicity, we refer to all of these as our “services” in this Privacy Policy. To make it extra clear, we’ve added links to this Privacy Policy on all applicable services.

Information you give us

You choose to give us certain information when using our services. This includes:

• When you create an account, you provide us with at least your phone number and email address, as well as some basic details necessary for the service to work, such as your first name, date of birth, relationship status and information about the kind of relationship you’re looking for, and profile tags.
• When you complete your profile, you have the option to share your ethnicity, position, and health information with us. Where you provide such elements to us, you consent to us using it for the purposes identified and as laid out in this Privacy Policy. You can also share additional information with us, such as details on your bio and your interests, as well as content such as photos and videos. To add certain content, like photos or videos, you may allow us to access your camera or photo album.
• When you subscribe to a paid service or make a purchase directly from us (rather than through a platform such as iOS or Android), you provide us with information related to the purchases you make and our payment processors with information such as your debit or credit card number or other financial information.
• When you participate in surveys, focus groups or market studies, you give us your insights into our products and services, responses to our questions and testimonials.
• When you choose to participate in our promotions, events or contests, we collect the information that you use to register or enter.

Users may provide information about you as they use our services, for instance as they interact with you or if they submit a report involving you.

• Social Media

You may decide to share information with us through your social media account, for instance if you decide to create or log into your Archer account via your social media or other account (e.g. Google or Apple) or to upload onto our services information, such as photos from one of your social media accounts (for example, Instagram).

• Other Partners

We may receive information about you from our partners where our ads are published on a partner’s service (in which case they may pass along details on a campaign’s success). Where legally allowed, we can also receive information about suspected or convicted bad actors from third parties as part of our efforts to ensure our users’ safety and security.

Information generated or automatically collected when you use our services

When you use our services, this generates technical data about which features you’ve used, how you’ve used them and the devices you use to access our services. See below for more details.

• Usage Information

Using the services generates data about your activity on our services, for instance how you use them (for example, when you logged in, features you’ve been using, actions taken, information shown to you, referring webpages address and ads that you interacted with) and your interactions with other users (for example, users you connect and interact with, and when you matched and exchanged messages with them).

• Device Information

We collect information from and about the device(s) you use to access our services, including hardware and software information such as IP address, device ID and type, apps settings and characteristics, app crashes, advertising IDs (which are randomly generated numbers that you can reset by going into your device’ settings and, in some cases, disable entirely), and identifiers associated with cookies or other technologies that may uniquely identify a device or browser.

• Information collected by cookies and similar technologies

We use and may allow others to use cookies and similar technologies (for example, web beacons, pixels and SDKs) to recognize you and/or your device(s). You may read Section 4 and our Cookie Policy for more information on why we use them and how you can better control their use.

Some web browsers (including Safari, Internet Explorer, Firefox and Chrome) have a “Do Not Track” (“DNT”) feature that tells a website that a user does not want to have his or her online activity tracked. If a website that responds to a DNT signal receives a DNT signal, the browser can block that website from collecting certain information about the browser’s user. Not all browsers offer a DNT option and DNT signals are not yet uniform. For this reason, many businesses, including Archer, do not currently respond to DNT signals.

• Other information with your consent
  • Precise geolocation data: If you give us your consent, we can collect your precise geolocation (latitude and longitude) from your device. The collection of your geolocation may occur in the background even when you aren’t using the services if the permission you gave us expressly permits such collection. If you decline permission for us to collect your precise geolocation, we will not collect it, and our services that rely on precise geolocation may not be available to you.
  • Selfie Verification data: When you verify your profile using our Selfie Verification feature, we collect your face geometry data, which may be considered biometric data in some jurisdictions, to help verify that you’re the real you. You can learn more about Selfie Verification and how we process your face geometry data here. If you choose not to verify your profile, we will not collect your face geometry data and our services may not be available to you.
  • Other information: We may collect other information with your permission, such as photos and videos. 

4. HOW WE USE INFORMATION

The main reason we use your information is to deliver and improve our services. Additionally, we use your information to help keep you and our community safe, and to provide you with advertising that may be of interest to you. Additional Information about Advertising

We may publish ads about third-party advertisers’ products and services on our service and publish ads promoting our own service on third-party sites and apps. To help improve the relevance of these ads, we provide certain info about you (such as device information and identifiers like your IP address and advertising identifiers, usage information like links clicked and conversion information, and demographic information like your age, gender and interests) to third parties, including advertising partners, or allow them to collect such information from our services (such as via cookies, SDKs, or similar technologies). Some of our advertising partners enable us to transform your email address, advertising identifiers or phone number into an identifier that can’t be used to identify you personally and then use that unique identifier to either exclude you from our marketing campaigns, or to target our ads at an audience that is similar to you in terms of background, interests or app usage. If you live in the United States, some of the activities described in this section may constitute “targeted advertising,” “sharing,” or “selling” under applicable  laws, and we give you the choice to opt-out, as described in Section 8. To process your information as described in this Privacy Policy, we rely on the following legal bases:

• Provide our service to you: The reason we process your information for purposes A and B above is to perform the contract that you have with us. For instance, as you go about using our service to build meaningful connections, we use your information to maintain your account and your profile, make it viewable to other users and recommend other users to you and to otherwise provide our free and paid features to you and other users.
• Legitimate interests: We process your information for purposes C, D and E above, based on our legitimate interest. For instance, we analyze users’ behavior on our services to continuously improve our offerings, we suggest offers we think might interest you and promote our own services, we process information to help keep our users safe and we process data where necessary to enforce our rights, assist law enforcement and enable us to defend ourselves in the event of a legal action.
• Comply with applicable laws and regulations: We process your information for purpose F above where it is necessary for us to comply with applicable laws and regulations and evidence our compliance with applicable laws and regulations. For example, we retain traffic data and data about transactions in line with our accounting, tax and other statutory data retention obligations and to be able to respond to valid access requests from law enforcement. We also keep data evidencing consents users give us and decisions they may have taken to opt-out of a given feature or processing.
• Consent: If you choose to provide us with information that may be considered “special” or “sensitive” in certain jurisdictions, such as your sexual orientation, you’re consenting to our processing of that information in accordance with this Privacy Policy. From time to time, we may ask for your consent to collect specific information such as your precise geolocation or use your information for certain specific reasons. In some cases, you may withdraw your consent by adapting your settings (for instance in relation to the collection of precise geolocation) or by deleting your content (for instance where you entered information in your profile that may be considered “special” or “sensitive”). In any case, you may withdraw your consent at any time by contacting us at the address provided at the end of this Privacy Policy.

5. HOW WE SHARE INFORMATION

Since our goal is to help you make meaningful connections, the main sharing of users’ information is, of course, with other users. We also share some types of users’ information in connection with the activities explained in Section 4 above and with service providers and partners who assist us in operating the services, with other Match Group companies for specified reasons as laid out below and, in some cases, legal authorities. Read on for more details about how your information is shared with others.

• With other users

You share information with other users when you voluntarily disclose information on the service, including your public profile, and, if you choose to share them, your private albums. Please be careful with your information and make sure that the content you share is stuff that you’re comfortable being visible.

If you choose to limit the audience for all or part of your profile or for certain content or information about you, then it will be visible according to your settings.

If someone submits a report involving you (such as a claim that you violated our Terms of Use or Community Guidelines), we may communicate to the reporter actions, if any, we took as a result of their report.

• With our service providers and partners

We share information with vendors who help us operate, distribute, market and improve our services, such as data hosting and maintenance, analytics, customer care, marketing, advertising, payment processing and security operations. 

We follow a strict vetting process prior to engaging any vendor or working with any partner. Our vendors and partners must agree to strict confidentiality obligations.

• For corporate transactions

We may transfer your information if we are involved, whether in whole or in part, in a merger, sale, acquisition, divestiture, restructuring, reorganization, dissolution, bankruptcy or other change of ownership or control.

• With law enforcement / when required by law

We may disclose your information if reasonably necessary: (i) to comply with a legal process, such as a court order, subpoena or search warrant, government / law enforcement investigation or other legal requirements; (ii) to assist in the prevention or detection of crime (subject in each case to applicable law); or (iii) to protect the safety of any person.

• To enforce legal rights

We may also share information: (i) if disclosure would mitigate our liability in an actual or threatened lawsuit; (ii) as necessary to protect our legal rights and legal rights of our users, business partners or other interested parties; (iii) to enforce our agreements with you; and (iv) to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing.

• With your consent or at your request

We may ask for your consent to share your information with third parties. In any such case, we will make it clear why we want to share the information.

We may use and share non-personal information (meaning information that, by itself, does not identify who you are such as device information, general demographics, general behavioral data, location in de-identified form), as well as personal information in hashed, non-human readable form, under any of the above circumstances. 

6. HOW MATCH GROUP COMPANIES WORK TOGETHER

Archer is part of the Match Group family of businesses.

We may share information about you with our affiliates and they may share information about you with us, for the reasons laid out below:

• To make all Match Group platforms safer, for instance by making sure that when a bad actor is found on one Match Group platform (for instance ours), they can be banned from all.
• To assist each other in data processing operations, as processors. This assistance may include technical processing operations, such as data hosting and maintenance, customer care, marketing and advertising, analytics, finance and accounting, payment processing, service improvement, data security and fighting against spam, abuse, fraud, infringement and other wrongdoings.
• To improve your chances at building significant connections with others, we may make you visible on other Match Group services or allow you to benefit from cross-platform functionalities.  We will of course comply with applicable law and, where relevant, notify you of any such opportunity and allow you to agree or to refuse.
• If you are located in the USA excluding California, Colorado, Utah, Connecticut and Virginia, to personalize your experience on Match Group platforms, including how you’re shown to other users and how others are shown to you, prices, discounts, ads and content you experience, to improve our marketing campaigns.
• For other legitimate business purposes including corporate audit, analysis and consolidated reporting.

7. CROSS-BORDER DATA TRANSFERS

The sharing of information laid out in Section 5 involves cross-border data transfers to the United States of America and other jurisdictions that may have different laws about data processing. When we transfer personal information outside of the EEA, the United Kingdom, Switzerland or other countries which data protection laws have been deemed adequate by the European Commission or other competent governmental body, we use standard contract clauses (standard contractual clauses are commitments between companies transferring personal data, binding them to protect the privacy and security of your data) or other appropriate transfer mechanism. We are currently in the process of reviewing transfers to our vendors and associated legal basis further to the recent Court of Justice for the European Union’s ruling on transfers of personal data to the USA.

8. YOUR RIGHTS AND CHOICES

We want you to be in control of your information, so we want to remind you of the following options and tools available to you:

• Access / Update tools in the service. Tools and account settings can help you access, rectify or remove information that you provided to us and that’s associated with your account directly within the service. If you have any questions on those tools and settings, please contact our customer care team for help by submitting a request here.
• Device permissions. Mobile platforms can have permission systems for specific types of device data and notifications, such as phone contacts, pictures, location services, push notifications and advertising identifiers. You can change your settings on your device to either consent or oppose the collection or processing of the corresponding information or the display of the corresponding notifications. Of course, if you do that, certain services may lose functionality.
• Uninstall. You can stop all information collection by an app by uninstalling it using the standard uninstall process for your device. Remember that uninstalling an app does NOT close your account. To close your account, please use the corresponding functionality on the service.
• Account closure. You can close your account by using the corresponding functionality directly on the service.

We also want you to be aware of your privacy rights. Depending on where you live, you may have the right to: 

• Access/know. You may have the right to request a copy of the information we keep about you, and in certain circumstances to receive this in a portable format. You can exercise your right to access by putting in a request here.
• Delete/erase.You may request that we delete the personal information we keep about you. You can exercise your right to delete by submitting a request here.
• Correct/rectify/update. You can correct most information you provided to us by editing your profile directly in the service. If you believe the information we hold about you is inaccurate, you may contact us here to rectify it.
• Object/restrict. You may also have the right to object to or request that we restrict certain processing. To do so, please contact us here.
• Opt-out of Targeted Advertising, “Sales” and “Sharing.” As explained above, if you live in the United States, you may opt out of our activities that may constitute “targeted advertising,” “sales,” and “sharing” under applicable laws. To do so, please visit the “Your Privacy Choices” link in the footer of our website and in the Settings menu of the app and set the “Do Not Sell or Share My Personal Information” toggle to the “on” position. Authorized agents may submit opt-out requests on behalf of consumers here. 

For your protection and the protection of all of our users, we may ask you to provide proof of identity before we can answer the above requests. Keep in mind, we may reject requests, including if we are unable to authenticate you, if the request is unlawful or invalid, or if it may infringe on trade secrets or intellectual property or the privacy or other rights of someone else. If you wish to receive information relating to another user, such as a copy of any messages you received from them through our service, the other user will have to contact us to submit a separate request for their information. We may also ask them to provide proof of identity before we can answer the request.

If you are a resident of Virginia, Colorado, or Connecticut, USA, if we deny your privacy request, you may be able to appeal by contacting us here and explicitly referencing “Privacy Request Appeal” in the subject line. If you have concerns about the result of your appeal you may contact the attorney general for your state. Additionally, please note that we do not use your personal data for “profiling” in furtherance of decisions that produce legal or similarly significant effects, as those terms are defined by applicable law in your state, so no opt-out choice is necessary. 

In certain countries, including in the European Economic Area and the United Kingdom, if Archer is available in your area, you have a right to lodge a complaint with the appropriate data protection authority if you have concerns about how we process your personal information. The data protection authority you can lodge a complaint with may be that of your habitual residence, where you work or where an alleged infringement took place.

9. HOW LONG WE RETAIN YOUR INFORMATION

We keep your personal information only as long as we need it for legitimate business purposes (as laid out in Section 4) and as permitted by applicable law. If you decide to stop using our services, you can close your account. Note that we will close your account automatically if you are inactive for a period of two years. 

10. NO CHILDREN ALLOWED

Our services are restricted to individuals who are 18 years of age or older. We do not permit individuals under the age of 18 on our platform. If you suspect that a user is under the age of 18, please use the reporting mechanism available on the service.

11. JOB CANDIDATES, CONTRACTORS AND VENDOR REPRESENTATIVES

We also process the personal information of our job candidates, contractors and vendor representatives, as part of our recruitment and talent management operations and our management of the services that contractors and vendors provide to us. If you are a job candidate, contractor or vendor representative of Archer, certain relevant terms of this Privacy Policy apply to our processing of your personal information, including the sections of this Privacy Policy that discuss the entity that is responsible for the processing of your personal information, transfers of personal information, rights you may have under applicable law, how to contact us and California-specific information.

If you are a job applicant, the personal information we process about you may vary depending on the job you seek but typically includes what you provide to us as part of your job application as well as professional qualifications, background and reference information that recruiters or other third parties share with us. We use this information to support the recruitment process, which may lead to an employment contract. For contractors and vendor representatives, we may process identification information and work-related information, as necessary to manage our relationship with you and your employer, which is necessary for the performance of the services agreement, and to establish, exercise or defend potential legal claims.   • Selfie Verification data: When you verify your profile using our Selfie Verification feature, we collect your face geometry data, which may be considered biometric data in some jurisdictions, to help verify that you’re the real you. You can learn more about Selfie Verification and how we process your face geometry data here. If you choose not to verify your profile, we will not collect your face geometry data and our services may not be available to you.
  • Other information: We may collect other information with your permission, such as photos and videos. 

4. HOW WE USE INFORMATION

The main reason we use your information is to deliver and improve our services. Additionally, we use your information to help keep you and our community safe, and to provide you with advertising that may be of interest to you. Read on for a more detailed explanation of the various reasons for which we use your information, together with practical examples.

To process your information as described in this Privacy Policy, we rely on the following legal bases:

• Provide our service to you: The reason we process your information for purposes A and B above is to perform the contract that you have with us. For instance, as you go about using our service to build meaningful connections, we use your information to maintain your account and your profile, make it viewable to other users and recommend other users to you and to otherwise provide our free and paid features to you and other users.
• Legitimate interests: We process your information for purposes C, D and E above, based on our legitimate interest. For instance, we analyze users’ behavior on our services to continuously improve our offerings, we suggest offers we think might interest you and promote our own services, we process information to help keep our users safe and we process data where necessary to enforce our rights, assist law enforcement and enable us to defend ourselves in the event of a legal action.
• Comply with applicable laws and regulations: We process your information for purpose F above where it is necessary for us to comply with applicable laws and regulations and evidence our compliance with applicable laws and regulations. For example, we retain traffic data and data about transactions in line with our accounting, tax and other statutory data retention obligations and to be able to respond to valid access requests from law enforcement. We also keep data evidencing consents users give us and decisions they may have taken to opt-out of a given feature or processing.
• Consent: If you choose to provide us with information that may be considered “special” or “sensitive” in certain jurisdictions, such as your sexual orientation, you’re consenting to our processing of that information in accordance with this Privacy Policy. From time to time, we may ask for your consent to collect specific information such as your precise geolocation or use your information for certain specific reasons. In some cases, you may withdraw your consent by adapting your settings (for instance in relation to the collection of precise geolocation) or by deleting your content (for instance where you entered information in your profile that may be considered “special” or “sensitive”). In any case, you may withdraw your consent at any time by contacting us at the address provided at the end of this Privacy Policy.

5. HOW WE SHARE INFORMATION

Since our goal is to help you make meaningful connections, the main sharing of users’ information is, of course, with other users. We also share some types of users’ information with service providers and partners who assist us in operating the services, with other Match Group companies for specified reasons as laid out below and, in some cases, legal authorities. Read on for more details about how your information is shared with others.

• With other users

You share information with other users when you voluntarily disclose information on the service, including your public profile, and, if you choose to share them, your private albums. Please be careful with your information and make sure that the content you share is stuff that you’re comfortable being visible.

If you choose to limit the audience for all or part of your profile or for certain content or information about you, then it will be visible according to your settings.

If someone submits a report involving you (such as a claim that you violated our Terms of Use or Community Guidelines), we may communicate to the reporter actions, if any, we took as a result of their report.

• With our service providers and partners

We share information with vendors who help us operate, distribute, market and improve our services, such as data hosting and maintenance, analytics, customer care, marketing, advertising, payment processing and security operations. We also share information with vendors who distribute and assist us in advertising our services. For instance, we may share limited information on you in hashed, non-human readable form to advertising vendors.

We follow a strict vetting process prior to engaging any vendor or working with any partner. Our vendors and partners must agree to strict confidentiality obligations.

• For corporate transactions

We may transfer your information if we are involved, whether in whole or in part, in a merger, sale, acquisition, divestiture, restructuring, reorganization, dissolution, bankruptcy or other change of ownership or control.

• With law enforcement / when required by law

We may disclose your information if reasonably necessary: (i) to comply with a legal process, such as a court order, subpoena or search warrant, government / law enforcement investigation or other legal requirements; (ii) to assist in the prevention or detection of crime (subject in each case to applicable law); or (iii) to protect the safety of any person.

• To enforce legal rights

We may also share information: (i) if disclosure would mitigate our liability in an actual or threatened lawsuit; (ii) as necessary to protect our legal rights and legal rights of our users, business partners or other interested parties; (iii) to enforce our agreements with you; and (iv) to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing.

• With your consent or at your request

We may ask for your consent to share your information with third parties. In any such case, we will make it clear why we want to share the information.

We may use and share non-personal information (meaning information that, by itself, does not identify who you are such as device information, general demographics, general behavioral data, location in de-identified form), as well as personal information in hashed, non-human readable form, under any of the above circumstances. We may also share this information with other Match Group companies and third parties (notably advertisers) to develop and deliver targeted advertising on our services and on websites or applications of third parties, and to analyze and report on advertising you see. We may combine this information with additional non-personal information or personal information in hashed, non-human readable form collected from other sources. 6. HOW MATCH GROUP COMPANIES WORK TOGETHER

Archer is part of the Match Group family of businesses.

We may share information about you with our affiliates and they may share information about you with us, for the reasons laid out below:

• To make all Match Group platforms safer, for instance by making sure that when a bad actor is found on one Match Group platform (for instance ours), they can be banned from all.
• To assist each other in data processing operations, as service providers. This assistance may include technical processing operations, such as data hosting and maintenance, customer care, marketing and targeted advertising, analytics, finance and accounting, payment processing, service improvement, data security and fighting against spam, abuse, fraud, infringement and other wrongdoings.
• To improve your chances at building significant connections with others, we may make you visible on other Match Group services or allow you to benefit from cross-platform functionalities.  We will of course comply with applicable law and, where relevant, notify you of any such opportunity and allow you to agree or to refuse.
• If you are located in the USA excluding California, Colorado, Utah, Connecticut and Virginia, to personalize your experience on Match Group platforms, including how you’re shown to other users and how others are shown to you, prices, discounts, ads and content you experience, to improve our marketing campaigns.
• For other legitimate business purposes including corporate audit, analysis and consolidated reporting.

7. CROSS-BORDER DATA TRANSFERS

The sharing of information laid out in Section 5 involves cross-border data transfers to the United States of America and other jurisdictions that may have different laws about data processing. When we transfer personal information outside of the EEA, the United Kingdom, Switzerland or other countries which data protection laws have been deemed adequate by the European Commission or other competent governmental body, we use standard contract clauses (standard contractual clauses are commitments between companies transferring personal data, binding them to protect the privacy and security of your data) or other appropriate transfer mechanism. We are currently in the process of reviewing transfers to our vendors and associated legal basis further to the recent Court of Justice for the European Union’s ruling on transfers of personal data to the USA.

8. YOUR RIGHTS AND CHOICES

We want you to be in control of your information, so we want to remind you of the following options and tools available to you:

• Access / Update tools in the service. Tools and account settings can help you access, rectify or remove information that you provided to us and that’s associated with your account directly within the service. If you have any questions on those tools and settings, please contact our customer care team for help by submitting a request here.
• Device permissions. Mobile platforms can have permission systems for specific types of device data and notifications, such as phone contacts, pictures, location services, push notifications and advertising identifiers. You can change your settings on your device to either consent or oppose the collection or processing of the corresponding information or the display of the corresponding notifications. Of course, if you do that, certain services may lose functionality.
• Uninstall. You can stop all information collection by an app by uninstalling it using the standard uninstall process for your device. Remember that uninstalling an app does NOT close your account. To close your account, please use the corresponding functionality on the service.
• Account closure. You can close your account by using the corresponding functionality directly on the service.

We also want you to be aware of your privacy rights. Depending on where you live, you may have the right to: 

• Access/know. You may have the right to request a copy of the information we keep about you, and in certain circumstances to receive this in a portable format. You can exercise your right to access by putting in a request here.
• Delete/erase.You may request that we delete the personal information we keep about you. You can exercise your right to delete by submitting a request here.
• Correct/rectify/update. You can correct most information you provided to us by editing your profile directly in the service. If you believe the information we hold about you is inaccurate, you may contact us here to rectify it.
• Object/restrict. You may also have the right to object to or request that we restrict certain processing. To do so, please contact us here.

For your protection and the protection of all of our users, we may ask you to provide proof of identity before we can answer the above requests. Keep in mind, we may reject requests, including if we are unable to authenticate you, if the request is unlawful or invalid, or if it may infringe on trade secrets or intellectual property or the privacy or other rights of someone else. If you wish to receive information relating to another user, such as a copy of any messages you received from them through our service, the other user will have to contact us to submit a separate request for their information. We may also ask them to provide proof of identity before we can answer the request.

If you are a resident of Virginia, Colorado, or Connecticut, USA, if we deny your privacy request, you may be able to appeal by contacting us here and explicitly referencing “Privacy Request Appeal” in the subject line. If you have concerns about the result of your appeal you may contact the attorney general for your state.  

In certain countries, including in the European Economic Area and the United Kingdom, if Archer is available in your area, you have a right to lodge a complaint with the appropriate data protection authority if you have concerns about how we process your personal information. You can find information about your data protection regulator in the European Economic Area here, and in the United Kingdom here. The data protection authority you can lodge a complaint with may be that of your habitual residence, where you work or where an alleged infringement took place.

9. HOW LONG WE RETAIN YOUR INFORMATION

We keep your personal information only as long as we need it for legitimate business purposes (as laid out in Section 4) and as permitted by applicable law. If you decide to stop using our services, you can close your account. Note that we will close your account automatically if you are inactive for a period of two years. 

10. NO CHILDREN ALLOWED

Our services are restricted to individuals who are 18 years of age or older. We do not permit individuals under the age of 18 on our platform. If you suspect that a user is under the age of 18, please use the reporting mechanism available on the service.

11. JOB CANDIDATES, CONTRACTORS AND VENDOR REPRESENTATIVES

We also process the personal information of our job candidates, contractors and vendor representatives, as part of our recruitment and talent management operations and our management of the services that contractors and vendors provide to us. If you are a job candidate, contractor or vendor representative of Archer, certain relevant terms of this Privacy Policy apply to our processing of your personal information, including the sections of this Privacy Policy that discuss the entity that is responsible for the processing of your personal information, transfers of personal information, rights you may have under applicable law, how to contact us and California-specific information.

If you are a job applicant, the personal information we process about you may vary depending on the job you seek but typically includes what you provide to us as part of your job application as well as professional qualifications, background and reference information that recruiters or other third parties share with us. We use this information to support the recruitment process, which may lead to an employment contract. For contractors and vendor representatives, we may process identification information and work-related information, as necessary to manage our relationship with you and your employer, which is necessary for the performance of the services agreement, and to establish, exercise or defend potential legal claims. We may share personal information with service providers that assist us with recruitment and technical data processing operations as well as with Match Group companies (for instance if you have a business relationship with employees of an affiliate). We keep your personal information only as long as necessary for those purposes.

12. PRIVACY POLICY CHANGES 

Because we’re always looking for new and innovative ways to help you build meaningful connections and strive to make sure explanations about our data practices remain up-to-date, this policy may change over time. We will notify you before any material changes take effect so that you have time to review the changes.
